Dispute Resolution Policy

1. Introduction

CollabJourneys provides a technology platform that connects travelers with independent partners organizing group tours. This Dispute Resolution Policy describes how disputes between travelers and partners may be addressed when arising in connection with the use of the platform.

CollabJourneys is not a party to the travel service agreement between travelers and partners and does not adjudicate disputes.

2. Definition of a Dispute

A dispute refers to a disagreement between a traveler and a partner relating to a tour booked through the CollabJourneys platform, including but not limited to matters concerning tour services, cancellations, refunds, or communications.

3. Direct Resolution Between the Parties

3.1. Primary Responsibility

Travelers and partners are encouraged to first attempt to resolve disputes directly with each other through the communication tools provided on the platform or via other agreed communication channels.

3.2. Good Faith Communication

Both parties are expected to engage in good faith, provide accurate information, and make reasonable efforts to reach a mutually acceptable resolution.

4. Role of CollabJourneys

4.1. Facilitation Only

Upon request, CollabJourneys may assist as a facilitator of communication between the traveler and the partner by helping relay information or clarify platform-related processes.

4.2. No Adjudication or Arbitration

CollabJourneys does not:

  • act as an arbitrator, mediator, or judge,
  • make binding or non-binding decisions on disputes,
  • determine fault or liability, or
  • guarantee any specific outcome.

Any resolution remains solely at the discretion of the traveler and the partner.

5. Limitation of Responsibility

CollabJourneys:

  • does not investigate disputes on their merits,
  • does not verify or evaluate evidence submitted by either party, and
  • is not responsible for enforcing refunds, compensation, or remedies determined by a partner.

Disputes related to tour performance, cancellations, refunds, or damages are the sole responsibility of the partner, subject to applicable law and the partner’s stated policies.

6. External Remedies

If a dispute cannot be resolved directly between the traveler and the partner, either party may pursue resolution through external legal or regulatory channels, including courts or consumer protection authorities, in accordance with applicable law.

CollabJourneys is not responsible for the outcome of such proceedings.

7. Confidentiality

Information shared during dispute-related communications will be handled with reasonable confidentiality.

However, CollabJourneys may disclose information where required to do so by:

  • applicable law,
  • court orders,
  • regulatory authorities, or
  • payment service providers in connection with chargebacks or compliance obligations.

8. Cooperation

Travelers and partners are expected to cooperate reasonably with any communication facilitated through the platform and to provide accurate and truthful information when requesting assistance.

9. Policy Updates

CollabJourneys reserves the right to modify or update this Dispute Resolution Policy at any time. The most current version will be made available on the platform.

10. Acceptance

By using the CollabJourneys platform, users acknowledge that:

  • disputes arise between travelers and partners,
  • CollabJourneys acts solely as a platform and communication facilitator, and
  • CollabJourneys does not provide arbitration, mediation, or binding dispute resolution services.
