These Terms of Use govern access to and use of the CollabJourneys platform. By accessing or using the platform, you agree to be bound by these Terms.

1. Platform Overview

CollabJourneys provides an online marketplace platform that enables users to discover and book group and individual tours offered by independent third-party partners.

CollabJourneys acts solely as a technology platform and intermediary and does not organize, curate, or deliver tours.

2. Definitions

• Platform – the CollabJourneys online marketplace.
• Partner – an independent third party that lists and provides tours on the platform.
• Traveler – a registered user who browses, books, or joins tours offered by Partners.
• Listing – information about a tour published by a Partner, including itinerary, pricing, and conditions.
• Booking – a reservation made by a Traveler for a Partner’s tour through the platform.
• User Content – any content submitted or displayed on the platform by users, including reviews, text, images, or messages.
• User – any person accessing or using the platform, including Travelers and Partners.

3. Role of CollabJourneys

CollabJourneys does not provide travel services and is not a tour operator or travel agency.

Partners are solely responsible for their tours, listings, pricing, availability, performance, and compliance with applicable laws.

CollabJourneys does not control, endorse, or guarantee any tour or Partner.

Any agreement for a tour is formed directly between the Traveler and the Partner.

4. Registration and Account Security

Users must provide accurate and up-to-date information when creating an account.

Users are responsible for maintaining the confidentiality of their account credentials.

Users are responsible for all activities conducted through their account.

Multiple accounts are not permitted unless expressly approved.

Account Suspension or Termination

CollabJourneys may suspend or terminate an account to the extent permitted by applicable law, including for violations of these Terms or platform policies.

Where practicable, reasonable notice will be provided.

5. User Content

Responsibility

Users are solely responsible for the content they submit. User Content reflects the views of the user and not those of CollabJourneys.

Intellectual Property

Users must have all necessary rights to the content they submit and agree to indemnify CollabJourneys against claims arising from such content.

Accuracy of Listings

Partners must ensure that their listings are accurate, complete, and not misleading.

Moderation

CollabJourneys may remove or restrict content at its discretion but is under no obligation to do so.

External Links

Links to external resources are not permitted without the express approval of CollabJourneys.

Unauthorized links may result in content removal or account suspension.

6. Reviews and Feedback

Travelers may submit reviews based on their genuine experience.

Reviews that are false, misleading, fabricated, or submitted with the intent to harm the reputation of CollabJourneys or its Partners without factual basis are not permitted.

CollabJourneys may remove or moderate reviews at its discretion.

7. Transactions and Payments

Marketplace Model

CollabJourneys facilitates bookings and payment collection on behalf of Partners.

The Partner is the service provider.

CollabJourneys acts as a payment facilitator and technology intermediary.

Payments collected through the platform are intended for the Partner, less applicable platform fees.

Financial Responsibility

CollabJourneys is not responsible for how Partners use funds received.

CollabJourneys’ financial responsibility is limited solely to the platform fees it retains, if any.

8. Cancellations and Refunds

Cancellations and refunds are governed by the Payment & Cancellation Policy and the Partner’s stated terms.

CollabJourneys does not guarantee refunds and does not override Partner policies.

9. Disputes

Disputes between Travelers and Partners must be resolved directly between them.

CollabJourneys may assist with communication but:

• does not adjudicate disputes,
• does not make binding decisions, and
• is not liable for dispute outcomes.

10. Disclaimer and Limitation of Liability

The platform is provided “as is” and “as available.”

To the maximum extent permitted by law:

• CollabJourneys disclaims all express and implied warranties;
• CollabJourneys is not liable for indirect, incidental, consequential, or punitive damages;
• CollabJourneys is not liable for the acts, omissions, or services of Partners or other users.

11. Privacy and Data Protection

Personal data is processed in accordance with the Privacy & Cookies Policy, which forms an integral part of these Terms.

12. Modifications

CollabJourneys may update these Terms from time to time.

Material changes will be communicated where required by law.

13. Governing Law

These Terms shall be governed and interpreted in accordance with applicable law, without regard to conflict of law principles.

14. Third-Party Websites

The platform may contain links to third-party websites.

CollabJourneys is not responsible for their content or practices.
